Please read these Terms of Service ("Terms") carefully before using WhereAt ("App"). WhereAt is developed and operated by an individual independent developer ("I," "me," "my," "the developer"), not a company.

By downloading, installing, or using the App in any way, you ("you," "user") agree to be legally bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Who Operates the App

WhereAt is an independent mobile application developed and maintained by a single individual developer based in Slovenia, European Union. It is not a product of a registered company. All references to "WhereAt," "I," "me," or "the developer" in these Terms refer to that individual.

2. Eligibility

You must be at least 18 years old to use WhereAt. By using the App, you confirm that you meet this age requirement. I reserve the right to suspend or terminate accounts I reasonably believe belong to users who do not meet this requirement.

3. Your Account

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and truthful information
  • Keep your password confidential and not share it with anyone
  • Notify me immediately of any unauthorised access to your account at whereatapp@proton.me
  • Be solely responsible for all activity that occurs under your account

3.2 Account Termination

You may delete your account at any time through the Profile screen in the App. I may suspend or permanently terminate your account without prior notice if I reasonably believe you have violated these Terms.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse engineer, decompile, disassemble, or tamper with the App or its infrastructure
  • Create fake, duplicate, or impersonation accounts
  • Use automated tools, bots, or scrapers to access the App or its backend
  • Attempt to circumvent security measures, authentication, or access controls
  • Use the App to harass, abuse, stalk, threaten, or harm any person
  • Upload, transmit, or distribute malicious code or interfere with the App's operation
  • Misrepresent your identity or affiliation with any person or entity

I reserve the right to suspend or permanently ban any user who violates these rules, at my sole discretion, without prior notice or refund of any kind.

5. Venue Data and Place Information

WhereAt displays information about third-party venues — including bars, restaurants, cafes, outdoor locations, and other establishments — sourced from the Google Places API and other data providers.

You expressly acknowledge and agree that:

  • I do not own, operate, affiliate with, or endorse any venue displayed in the App
  • Venue data including names, addresses, opening hours, ratings, photos, and categories is sourced from third parties and may be inaccurate, outdated, incomplete, or misleading
  • I make no representation that any venue will be open, available, safe, suitable, or as described at the time of your visit
  • I am not responsible for any loss, harm, disappointment, inconvenience, cost, or injury of any kind arising from your decision to visit or not visit a venue based on information shown in the App
  • You should independently verify all venue details before visiting, including opening hours, entrance requirements, and current conditions
  • Third-party venue data is subject to the terms and policies of its providers, including Google

6. The Spin Feature

The spin wheel is an entertainment feature designed to randomly suggest a nearby venue. The results are random and are not a recommendation, endorsement, or guarantee of any venue's quality, safety, suitability, or availability. I am not liable for any outcome — positive or negative — resulting from following a spin result.

7. Third-Party Services

The App integrates with and depends on third-party services including but not limited to:

  • Supabase — database and authentication infrastructure
  • Google Places API — venue data and location services
  • Expo — app build platform and update delivery

These services are operated by their respective owners. I have no control over their availability, accuracy, conduct, or data practices. I am not responsible for any failure, outage, data loss, or harm caused by or arising from any third-party service. Your use of any third-party service is subject to that service's own terms and policies.

When you tap "Take me there" or "Let's Go," the App may open Apple Maps or Google Maps. Those applications are governed entirely by Apple's and Google's own terms and privacy policies. I have no responsibility for their content, accuracy, or operation.

8. Modifications and Discontinuation

I reserve the right, at any time and without prior notice, to:

  • Modify, suspend, or discontinue the App or any part of it
  • Change, add, or remove features
  • Alter or terminate access for any user or all users
  • Change these Terms

I have no obligation to maintain, update, or continue operating the App. The App may become unavailable at any time, temporarily or permanently, with or without notice. I am not liable to you or any third party for any modification, suspension, or discontinuation of the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, I expressly disclaim all warranties, including but not limited to:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components
  • Any warranty as to the accuracy, reliability, completeness, or timeliness of any content, venue data, or information in the App
  • Any warranty that defects will be corrected or that the App or servers are free of harmful components

No oral or written information provided by me shall create any warranty not expressly stated in these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I — THE INDIVIDUAL DEVELOPER OF WHEREAT — SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Personal injury or property damage of any nature
  • Any harm arising from your reliance on information provided by the App
  • Any harm arising from your visit to, or inability to visit, any venue discovered through the App
  • Any service interruption, downtime, data loss, or security breach
  • Any act or omission of any third-party service including Supabase, Google, or Expo
  • Any unauthorised access to or alteration of your account or data

IN ANY CASE, MY TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED €10 (TEN EUROS).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If such laws apply to you, the above limitations may not apply in full, but I limit my liability to the greatest extent permitted by applicable law.

Nothing in these Terms limits liability for death or personal injury caused by gross negligence, fraud, or fraudulent misrepresentation, where such limitation is prohibited by law.

11. Indemnification

You agree to defend, indemnify, and hold me harmless from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of or access to the App
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any harm you cause to another person through your use of the App

12. Intellectual Property

All content in the App — including but not limited to the name "WhereAt," the design, logo, code, graphics, spin wheel, and user interface — is my intellectual property and is protected by copyright and applicable intellectual property law.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the App without my prior written permission.

By submitting a username or profile information, you grant me a non-exclusive, worldwide, royalty-free licence to use that content solely for the purpose of operating and displaying the App to you.

13. Privacy

Your use of the App is also governed by my Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the collection and use of your data as described in the Privacy Policy.

14. Apple App Store — Additional Terms

The App is distributed through the Apple App Store. The following terms apply as required by Apple:

  • These Terms are between you and the developer only — not between you and Apple
  • Apple is not a party to these Terms and has no obligation or liability to you under these Terms
  • Apple has no obligation whatsoever to provide any maintenance, technical support, or updates for the App
  • In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms shall govern with respect to your use of the App Store
  • To the extent any product liability, consumer protection, or similar claim arises in connection with the App, such claims are the developer's responsibility, not Apple's
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary

15. Changes to These Terms

I reserve the right to update these Terms at any time. The "Last updated" date at the top of this document reflects the most recent revision. I may notify you of material changes via an in-app notice, but I am not obligated to do so.

Your continued use of the App after updated Terms are posted constitutes your acceptance of those Terms. If you do not agree to the revised Terms, your only remedy is to stop using the App and delete your account.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions.

Any dispute arising from or related to these Terms or your use of the App shall first be attempted to be resolved informally by contacting me at whereatapp@proton.me. I will make reasonable efforts to respond within 30 days.

If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding the App and supersede all prior agreements, representations, or understandings — written or oral — relating to the App.

19. No Waiver

My failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any right in a specific instance does not constitute a waiver of that right in any future instance.
